In the National Bellas Hess case of 1967, and again in the Quill Office Supply V. North Dakota case of 1992, the US Supreme Court ruled in favor of the Commerce Clause of the Interstate Commerce Exemption of the US Constitution and held that the seller is not liable for the collection of sales tax on sales made to customers in states where they do not have a physical presence. Today the rules of engagement are changing. The volume of internet sales activity is rising at a geometric rate and the states are broke. Customers are not self-assessing tax on their internet and catalog purchases. The states desperately need relief.
